No 5 Garage Ltd (hereinafter referred to as “we”) accept vehicles for repair, testing, examination, sales or any other purpose only under the following terms and conditions:
- Estimates remain valid for 28 days only and are subject to price variations in supplier’s materials and parts. Also, where further damage is discovered on dismantling a vehicle, an estimate for additional parts and labour will be submitted.
- All efforts will be made to carry out any work authorised in good time but we shall not be liable for delays however caused.
- Payment is due on completion of repairs when notice has been given that the vehicle is ready for collection unless prior credit has been authorised.
- If an account has not been settled within three months of first rendering to the customer we may, without further notice, sell the vehicle and its contents. The net proceeds of the sale will be used to discharge any debt to us and the balance paid to the customer on demand.
- If a vehicle is uncollected after one week’s notice of completion of repairs, we will charge storage at our current rate (£45.00 per day + VAT).
- All estimates and quotations are deemed to be net of VAT which is to be added at the current rate (20%).
- All parts and labour itemised on our invoices are guaranteed for 6 months or 6000 miles, whichever occurs first, and attention is drawn to 8 below. The guarantee will be voided by customer or third party interference, normal wear and tear, negligence, abuse and accidental damage. Racing or rallying is also excluded unless specifically agreed.
- The guarantee only applies to our parts and labour and not to parts supplied by the customer or subcontractors called into our premises by the customer. Where parts are supplied by the customer or sub-contraction, the customer shall be deemed to accept all liability for any defect which thereafter arises.
- The customer is deemed to give us authority to drive the vehicle for any reasonable purpose such as road testing or inspection by a subcontractor. We may fill up to 15 litres of fuel without notice if the driver or tester believes the vehicle is about to run out of fuel.
- We cannot be held responsible for valuables or other items left in the vehicle unless specifically mentioned to us and noted down on the job card (i.e. cash, jewellery, luggage, etc). Customers should therefore remove attached items from the vehicle before repairs are undertaken.
- Parts fitted to vehicles remain our property until any related outstanding invoice is settled in full.
- Customers are responsible for settling any local congestion charges incurred whilst collecting or delivering their vehicles.
- Parts removed during the course of repairs may be discarded within 24 hours of the vehicle being delivered or collected by the customer unless otherwise agreed.
The customers’ statutory rights are not affected.
